A Cornwall firm has been found guilty of unpermitted storage and disposal of waste and must repay \u00a3600,000 under the Proceeds of Crime\u00a0Act.<\/h4>\n

Roger and Angela Smith, trading as R & A Cleansing, pleaded\u00a0guilty\u00a0to the offences at\u00a0Truro Crown Court. Both defendants were sentenced to 10 months in prison, suspended for 2 years, concurrent on each charge.\u00a0They must also remediate the site where the offences took place within 18 months.<\/p>\n

Under the Proceeds of Crime Act, the couple must now repay \u00a3600,000. They were\u00a0also\u00a0ordered to pay costs of \u00a310,000.<\/p>\n

R & A Cleansing Services\u00a0are\u00a0a liquid waste collection service that has been operating around the Cornwall area for 25 years.<\/p>\n

In 2023, the Environment Agency received an anonymous report that the company\u00a0were illegally storing and disposing of liquid waste on land owned by the husband-and-wife\u00a0team, who also reside\u00a0on site in a residential property.\u00a0<\/p>\n

While the company is a registered waste carrier, it holds no permits or waste exemptions, which would allow waste to be stored, treated or disposed of on site.<\/p>\n

Angela Smith stated that no disposal of waste had taken place on site and that the waste was being stored in underground tanks.\u00a0<\/p>\n

However, Environment Agency officers\u00a0found evidence of several underground tanks, two separate pools of heavily polluted water, tanker pipes lying on the ground, a pile of mixed domestic and building waste,\u00a0and\u00a0evidence of waste burning.<\/p>\n

Waste Transfer Notes\u00a0(WTNs)\u00a0indicated\u00a0that the wastes collected by the defendants included effluent treatments, animal\u00a0tissue waste, including blood, and septic tank sludge.<\/p>\n

Commenting on the sentencing, Sally Turberville, enforcement officer at the Environment Agency, said: \u201cIt\u00a0was\u00a0very concerning\u00a0that\u00a0large quantities\u00a0of untreated mixed liquid wastes\u00a0were\u00a0stored illegally\u00a0in unserviceable underground\u00a0tanks and open\u00a0pits.\u201d<\/p>\n

\u201cWaste\u00a0was\u00a0discharged straight onto the agricultural ground owned by the defendants\u00a0, and after\u00a0more than\u00a025 years in the\u00a0waste collection\u00a0business, they\u00a0should have\u00a0been\u00a0fully aware of the regulations.\u201d<\/p>\n

\u201cAs the business grew, there was no investment in\u00a0appropriate equipment\u00a0or\u00a0infrastructure,\u00a0no application made for an environmental permit.\u201d<\/p>\n
